Terms & acceptable use
The short version: report honestly, about numbers rather than people, and keep it clean.
These terms apply to your use of badcall.com.au, operated by XTO Pty Ltd (ACN 702 801 410). By using the site or posting a report you agree to them.
The rules for reports
When you post a report you promise that it is your own honest account of a call or message you received, and that it does not:
- include anyone's full name, home address, email address, bank or card details, or other personal information;
- threaten, harass, abuse or vilify anyone, or contain hate speech;
- make claims you know are false, or that you can't reasonably believe are true;
- advertise anything, link to anything for profit, or promote "scam recovery" services;
- post the same report across many numbers, or report numbers you have never been contacted by.
Reports that break the rules may be held, hidden or removed - automatically or by us - without notice.
Your licence to us
You keep ownership of what you write, and give XTO Pty Ltd a worldwide, royalty-free, perpetual licence to publish, display, adapt and distribute it (including through our API and feed) as part of the service.
What BadCall is - and isn't
Reports are the opinions and experiences of members of the public. We don't verify them, and the BadCall Score is a summary of those reports, not a finding of fact. Business details come from public listings and may be out of date. Caller ID can be faked, so a number on a call doesn't prove who made it. Use BadCall as one signal among others and use your own judgement.
BadCall is not affiliated with Scamwatch, the ACCC, ACMA, any police force, telco, bank or business named on the site.
Liability
To the fullest extent permitted by law, the service is provided "as is", and XTO Pty Ltd is not liable for any loss arising from your use of or reliance on the site or its content. Nothing in these terms excludes rights you have under the Australian Consumer Law that can't be excluded.
The API and feed
You may use the API and the feed within the rate limits, with a visible link back to the number's page on BadCall. Don't use them to build a list of people to contact, to harass anyone, or to resell the data as your own.
Changes and law
We may update these terms; the version on this page applies. These terms are governed by the law of New South Wales, Australia.
